Service Provider Camera Usage Agreement

Terms & Conditions for Professional Service Providers Using Pronto-Provided Recording Equipment

Digital Personal Data Protection Act, 2023

These Terms govern the use of Pronto-provided camera-enabled recording devices by Professional Service Providers engaged through the Pronto platform to provide household services (“Services”) in compliance with the Digital Personal Data Protection Act, 2023 (“DPDPA”) and any other applicable data protection regulations in India. These Terms establish the framework for the use by the Professional Service Provider of Pronto-provided recording devices, the capture and processing of Data through such devices, and the obligations and rights of the Professional Service Provider in connection with such Recordings.

Pronto owns the recording equipment and acts as the Data Fiduciary in respect of all Data captured through such equipment, determining the purpose and means of processing such Data in accordance with these Terms and the DPDPA. Professional Service Providers are authorized to operate Pronto cameras only in accordance with these Terms and Pronto’s instructions.

By accepting this Agreement, the Service Provider agrees to:

  • Operate only Pronto-provided recording equipment as authorized
  • Comply with all instructions regarding camera placement, recording schedule, and data protection
  • Respect the privacy rights of household members and other individuals encountered during service provision
  • Acknowledge Pronto’s role as Data Fiduciary in respect of all Recordings and Data captured
  • Not tamper with, disable, or obstruct the camera during authorized recording periods.

Definitions

Service Provider (also referred to as “Professional Service Provider”) or You: A professional individual engaged by Pronto to provide the Services and authorized to operate Pronto-provided recording devices in accordance with these Terms and applicable law.

Camera / Camera-enabled Recording Device: A portable, camera-enabled audio-visual recording device deployed by Pronto and worn on your body (chest, head, or shoulder) that continuously records during the authorized provision of Services.

Recordings: All video, audio and other Data (including images, voice, facial features and movement patterns) captured by the Camera during the provision of Services.

Services: Household services performed at registered premises through Pronto, including but not limited to dishwashing, cooking, cleaning, laundry, dusting, mopping, maintenance, gardening, pet care, childcare, eldercare, and similar domestic work.

Data: Any information, in any form, including text, images, audio, video or other digital or non-digital material, collected, recorded, stored or otherwise processed in connection with the provision of Services and the use of the Camera, and includes Personal Data.

Personal Data: Any Data about an identified or identifiable individual, including images, facial features, voice, movement patterns, activities, interactions and behavioural data captured through the Camera during the provision of Services.

Data Fiduciary: Pronto, which determines the purpose and means of processing of Data and Personal Data captured through the Camera in accordance with these Terms and the DPDPA, and processes and/or engages third parties to process such Personal Data on its behalf.

Consent: Your free, specific, informed, unconditional and unambiguous affirmative indication of agreement to the capture and processing of your Personal Data by Pronto in connection with the use of the Camera during the provision of Services, as described in these Terms.

Tamper Detection: Pronto automated systems that detect and log any attempt to disable, cover, obstruct, or tamper with the camera.

Confidentiality And Data Protection Obligations

You agree to maintain strict confidentiality of all Recordings, Data and Personal Data and comply with the following obligations:

  • Not disclose, share, or transmit Recordings, Data or Personal Data to anyone, including family members, friends, colleagues, other service providers, or any third party, whether orally, in writing, or via electronic means
  • Not store recordings on personal devices (phones, laptops, USB drives, personal cloud storage accounts, WhatsApp, email, or any personal messaging platform)
  • Not transmit recordings through unsecured channels or personal email accounts
  • Protect Pronto’s camera from theft, loss, damage, or unauthorized access
  • Immediately report any equipment malfunction, any Data or Personal data breach, unauthorized access, tampering suspicion, or suspected misuse to Pronto without delay upon becoming aware of the same, and in any event as soon as reasonably practicable, to enable Pronto to discharge its breach-notification obligations as Data Fiduciary under applicable law
  • Comply with all applicable data protection laws, including the DPDPA, and any rules, regulations or guidelines made thereunder
  • Maintain strict confidentiality of all Recordings, Data and Personal Data even after termination of your engagement with Pronto
  • Not attempt to identify, track, contact, or communicate with individuals appearing in Recordings outside of Pronto’s authorized purposes or as required by applicable law.

Camera: Technical Specifications & Operation

Equipment Type & Activation

Subject to acceptance of these Terms, You will be provided with a camera that:

  • Is worn on your body during all authorized services
  • Captures continuous video from your perspective during work activities
  • Is equipped with tamper detection and event logging
  • Transmits real-time video to encrypted cloud servers to prevent post-hoc tampering
  • Cannot be disabled by you during authorized recording periods, except with explicit written authorization.

Pronto reserves the right to charge you service fees at the rates, subject to applicable taxes and statutory levies.

Scope of Continuous Recording

Because you wear the camera on your body, it will capture your work activities, voice, facial features, movements. By accepting this Agreement, you consent to this continuous, ambient capture of data from your perspective during authorized work hours.

Pre-Recording Check & Protection of Personal Data

Prior to activating the Camera at the registered premises of an individual booking the Services, You shall:

  • take reasonable steps to satisfy yourself that no Personal Data of the individual booking the Services or of any third party present at the premises (including family members, visitors, domestic staff, or children) is visible in plain sight in the area where the Services are to be performed and recording is to take place; and
  • where any such Personal Data is observed, request the individual booking the Services to remove or shield such Personal Data before the recording commences, and to the extent practicable, defer activation of the Camera until such request has been complied with.

You shall further take reasonable care, during the provision of Services, not to expose Your own Personal Data within the field of view or audio range of the Camera, including by not displaying identity documents, financial information, screens or notifications on Your personal devices, or audio of personal communications, in a manner likely to be captured by the Camera. Where any such exposure becomes unavoidable, You shall promptly notify Pronto so that appropriate redaction may be considered as part of Pronto’s processing of the Recordings.

Tamper Detection & Anti-Tampering Obligations

Prohibited Actions

You shall NOT:

  • Deliberately cover, obstruct, or block the camera lens
  • Attempt to power off or disable the camera during authorized recording
  • Physically damage, tamper with, or modify the camera
  • Interfere with real-time transmission or cloud sync of recording data.

Tamper Detection & Logging

The camera automatically logs any power cycle, lens obstruction, data integrity failures, or timestamp gaps. Evidence of tampering is flagged in real-time for audit purposes.

Consequences of Tampering

Any evidence of tampering shall result in:

  • Immediate investigation by Pronto compliance team
  • Suspension of your access to camera-based services
  • Potential financial liability for equipment damage
  • Immediate termination if tampering is substantiated.

Monitoring And Audit Rights

Pronto reserves the following rights to ensure compliance with these Terms and data protection obligations:

  • Monitor your use of camera equipment in real-time, including when and where the camera is active, GPS location, power cycles, and all tamper detection events
  • Review recordings to assess service quality, client satisfaction, compliance with these Terms, area restrictions, and adherence to data protection obligations
  • Audit your compliance with confidentiality, data protection, and anti-tampering obligations at any time
  • Request documentation of your equipment care, use practices, data handling procedures, and compliance with Pronto’s privacy policies
  • Review and verify that you have not stored, retained, or transmitted recordings outside of Pronto’s systems
  • Take immediate disciplinary action (including suspension or termination) if you breach these Terms, fail to comply with data protection obligations, tamper with equipment, or violate any applicable law.

You acknowledge that Pronto’s monitoring is necessary for service quality, client protection, and legal compliance, and you consent to such monitoring as a condition of using Pronto-provided recording equipment.

Restrictions On Your Use Of Recordings

You strictly agree NOT to:

  • Copy, download, save, or retain any Recordings outside of Pronto secure systems
  • Share, disclose, or transmit Recordings to third parties (family, colleagues, social media)
  • Publish or broadcast Recordings on any platform
  • Use Recordings for harassment, blackmail, or any unlawful purpose
  • Modify, edit, or create derivative works from Recordings.

Limited Use of Your Personal Data

As Data Fiduciary, Pronto shall process Personal Data of the Professional Service Provider captured through the Camera solely for the specified purposes disclosed at the time of obtaining consent and in accordance with the DPDPA, including:

  • Service quality assessment (limited to Pronto internal staff)
  • Evidence preservation for dispute resolution
  • Investigation of alleged misconduct
  • Compliance with legal processes.

Anonymization for Analytics

For anonymized analytics, your face, voice, and identifying features will be redacted or removed.

Right to Decline Bookings

You have the right to decline camera-based bookings without penalty or retaliation.

Right to Withdraw Consent

You may withdraw consent to camera recording by providing notice to Pronto using the same or equivalent mechanism through which consent was given, with the ease of doing so being comparable to that with which consent was given, and as early as reasonably possible before a scheduled Service. Recordings made prior to withdrawal may be retained only where necessary for the specified purpose, including where a dispute, complaint or investigation is pending or where retention is required for compliance with applicable law; otherwise, they will be deleted, or irreversibly anonymized, within 07 (seven) calendar days or in accordance with the applicable retention policy.

Care And Maintenance Of Recording Equipment

You agree to:

  • Use equipment only as instructed
  • Wear it safely and securely
  • Not modify or tamper with equipment
  • Report any damage or malfunction immediately
  • Return equipment promptly upon request
  • Bear financial responsibility for loss or damage caused by your negligence.

Liability Limitations

Your limitations do NOT apply to wilful misconduct, fraud, unauthorized disclosure of Recordings or Personal Data, or breach of confidentiality obligations.

Termination

Pronto may immediately terminate your access if you tamper with equipment, breach these Terms, or violate data protection laws. Upon termination, you must return equipment and delete any retained Recordings.

Jurisdiction And Governing Law

This Agreement is governed by Indian law, specifically the Digital Personal Data Protection Act, 2023. Disputes shall be subject to exclusive jurisdiction of Indian courts.

Acknowledgment And Acceptance

By accepting this Agreement, you acknowledge that you have read, understood, and voluntarily agree to wear and operate the Camera as authorized, comply with all data protection obligations, acknowledge Pronto’s role as Data Fiduciary in respect of all Recordings and Personal Data captured through the Camera, and accept all rights and obligations herein.
